PETTY DEBTS COURT (JERSEY) RULES, 1967

THE SUPERIOR NUMBER OF THE ROYAL COURT, in pursuance of Article 11 of the Royal Court (Jersey) Law, 1948[1] and Article 2 of the Law Reform (Miscellaneous Provisions) (Jersey) Law, 1967,[2] and of all other powers enabling it in this behalf, has made the following Rules :  -

 

INTERPRETATION

1.-(1)  In these Rules –

“the Court” means the Petty Debts Court;

“the Greffier” means the Judicial Greffier;

“the Judge” means the Judge of the Court.

(2)     References in these Rules to any other enactment are references to that enactment as amended.

 

SERVICE OF DOCUMENTS GENERALLY

2.             Except where rules of court or any other enactment otherwise expressly provides or the Court otherwise orders, service of any document in any proceedings before the Court may be effected by personal service or ordinary service.

 

PERSONAL SERVICE : WHEN REQUIRED

3.             Personal service is required in the case of the following summonses for appearance before the Court, that is to say, a summons –

(a)     to reply to an action brought under Article 2 or 3 of the “Loi (1946) concernant l’expulsion des locataires réfractaires”;[3]

(b)     to reply to proceedings brought under the Separation and Maintenance Orders (Jersey) Law, 1953;[4]

(c)     to appear before the Court pursuant to Article 5 of the Maintenance Orders (Facilities for Enforcement) (Jersey) Law, 1953.[5]

 

SERVICE THROUGH THE INTERMEDIARY OF THE VISCOUNT’S DEPARTMENT : WHEN REQUIRED

4.             Service through the intermediary of the Viscount’s Department is required –

(a)     where personal service is required;

(b)     in the case of a summons to witness the confirmation of an arrest.

 

APPLICATION OF ROYAL COURT RULES RELATING TO SERVICE OF DOCUMENTS

5.             The following provisions of the Royal Court (Process, Fines and Forfeitures) (Jersey) Rules, 1967,[6] shall apply for the purposes of these Rules as they apply for the purposes of those Rules, that is to say –

Rule 7   (Ordinary service : how effected);

Rule 8   (Personal service : how effected);

Rule 9   (Personal service on body corporate);

Rule 10   (Personal service on the States or a Committee or other administration of the States);

Rule 11 (Substituted service);

Rule 12 (Service of process on agent of oversea principal);

Rule 13   (Service of process for recovery of land where no one appears to be in possession);

Rule 14 (Record of service);

subject, however, to the following modifications –

(a)     in Rule 8, all the words from “or, in the case of an order of justice” to the end shall be omitted;

(b)     in Rules 11, 12 and 13, for the references to the Court there shall be substituted references to the Judge.

 

TIME WITHIN WHICH SUMMONS TO BE SERVED

6.-(1)       Except where provision is otherwise made, a summons for appearance before the Court shall be served at least four clear days before the day on which the defendant is required to appear, and this Rule shall apply not only to the first summons in an action but also to all subsequent summonses therein.

(2)     The provisions of paragraphs (4), (5) and (6) of Rule 1B of the Royal Court (General) (Jersey) Rules, 1963,[7] shall apply for the purpose of the interpretation of this Rule.

 

JUDGEMENT BY DEFAULT NOT TO BE GIVEN WHERE SUMMONS NOT SERVED IN DUE TIME

7.             The Court shall not give judgement by default in any action unless it is satisfied that the summons was served in due time.

 

FORM OF SUMMONS AND RECORD OF SERVICE

8.             A summons and a record of service shall be in the appropriate form set out in the First Schedule to these Rules or in a form (in French or English) substantially to the like effect.

 

POWER TO SET ASIDE JUDGEMENTS BY DEFAULT

9.-(1)  Any judgement by default may be set aside by the Court on such terms as to costs or otherwise as it thinks fit.

(2)     An application under paragraph (1) of this Rule shall be supported by an affidavit stating the circumstances in which the default has arisen.

 

AMENDMENTS AND REPEALS

10.-(1)  The “Loi (1891) sur la Cour pour le recouvrement de menues dettes”[8] shall have effect subject to the amendments specified in the Second Schedule to these Rules.

(2)     The enactments specified in the Third Schedule to these Rules shall be repealed to the extent specified in the second column of that Schedule.

 

CITATION AND COMMENCEMENT

11.-(1)  These Rules may be cited as the Petty Debts Court (Jersey) Rules, 1967.

(2)     These Rules shall come into force on the first day of January, 1968:

Provided that, during the two months next following that date, the enactments amended and repealed by Rule 10 of these Rules shall continue to have effect as if these Rules had not been made and, during that period, the provisions of the said enactments and of these Rules shall have equal validity.

SECOND SCHEDULE

(Rule 10(1))

 

AMENDMENTS TO THE “LOI (1891) SUR LA COUR POUR LE RECOUVREMENT DE MENUES DETTES”.[9]

 

                1.             For Articles 5 and 6 there shall be substituted the following Articles -

 

Article 5.

 

                Les causes seront introduites par un ajour qui énoncera la désignation des parties, le lieu, le jour et l’heure de l’audience, et le montant et la nature de la demande.

 

Article 6.

 

                L’acteur remettra ou fera remettre un billet conforme à l’ajour au bureau du Greffier Judiciaire, au plus tard avant midi, le jour précédant celui de l’audience”.

 

                2.             In Article 19, for the words “la bille ou semonce” there shall be substituted the words “l’ajour”.

 

                3.             In sub-paragraph (b) of Article 24, for the word “billes” there shall be substituted the word “ajours”.

 

                4.             In sub-paragraph (c) of Article 24, for the words “les honoraries du prévôt” there shall be substituted the words “les frais de l’exploit”.
