PUBLIC HEALTH (SHIPS) (AMENDMENT) (JERSEY) ORDER, 1974.

THE PUBLIC HEALTH COMMITTEE, in pursuance of Article 2 of the Public Health (Vessels and Aircraft) (Jersey) Law, 1950,1 and after consultation with the Harbours and Airport Committee, hereby orders as follows:  -

1.             In Article 1 of the Public Health (Ships) (Jersey) Order, 19712 (hereinafter referred to as “the principal Order”) –

(a)     in the definition of “excepted area” after the words “the Netherlands” there shall be inserted the word “Spain”;

(b)     for the definition of “International Health Regulations” there shall be substituted the following definition –

“ ‘International Health Regulations’ means the International Health Regulations adopted by the 22nd World Health Assembly in 1969, as amended by the 26th World Health Assembly in 1973”;

(c)     for the definition of “valid International Vaccination Certificate” there shall be substituted the following definition –

“ ‘valid International Vaccination Certificate’ means a certificate of vaccination or revaccination against smallpox which –

(i)         being issued not later than the thirtieth day of November, 1974, is in the form specified in the Fifth Schedule to this Order, or a form substantially to the same effect; or

(ii)        being issued on or after the first day of December, 1974, is in the form laid down and conforms with the rules of validity contained in the Sixth Schedule to this Order”.

2.             In sub-paragraph (d) of Article 27 of the principal Order after the word “Article” there shall be inserted the words “may allow” and the words “may be allowed” shall be deleted.

3.             In paragraph (2) of Article 32 of the principal Order for the words “one hundred pounds” there shall be substituted the words “two hundred pounds”.

4.             For Article 36 of the principal Order there shall be substituted the following Article –

 

“SAVINGS

36.         Nothing in this Order shall affect the “Loi (1937) sur les Etrangers’ or the Immigration (Jersey) Order, 1972.”

5.             For Part II of the Fourth Schedule to the principal Order there shall be substituted the following part –

CHOLERA

(ARTICLE 5(5))

Infected ships and suspected ships

(1)          The medical officer –

(a)        may place under surveillance any person who disembarks from a ship, the period of surveillance being reckoned from the date of disembarkation from the ship;

(b)        shall be responsible for the supervision of the removal and safe disposal of any water, food (excluding cargo), human dejecta, waste water, including bilge water, waste matter, and any other matter which is considered to be contaminated, and shall be responsible for the disinfection of water tanks and food handling equipment.

(2)          Foodstuffs carried as cargo on board ships in which a case of cholera has occurred during the journey may not be subjected to bacteriological examination except by the health authorities of the country of final destination.”

6.             For the Sixth Schedule to the principal Order there shall be substituted the Schedule so numbered set out in the Schedule to this Order.

7.             This Order may be cited as the Public Health (Ships) (Amendment) (Jersey) Order, 1974, and shall come into force on the first day of December, 1974.

RULES

INTERNATIONAL CERTIFICATE OF VACCINATION OR REVACCINATION AGAINST SMALLPOX

The validity of this certificate shall extend for a period of three years beginning eight days after the date of a successful primary vaccination or, in the event of a revaccination, on the date of that revaccination.
