(Workplace Restrictions and Gathering Control) (Amendment) (Jersey) Order 2021

THE MINISTER FOR HEALTH AND SOCIAL SERVICES makes this Order under Regulations 2
and 3 of the Covid-19 (Workplace Restrictions) (Jersey) Regulations 2020[1] and after having complied with the consultation requirements set out in
Regulation 2(1) and (2) of those Regulations and under Regulation 2
of the Covid‑19 (Gatherings) (Jersey) Regulations 2020[2], after complying with the consultation requirements in
Regulation 2(3) of those Regulations –
1 Amendment of Covid-19
(Workplace Restrictions) (Jersey) Order 2020
Articles 2 to 7
amend the Covid-19 (Workplace Restrictions) (Jersey) Order 2020[3].
2 Article A1 (interpretation) amended
In Article A1 –
(a) for the definition
“indoor recreation facility” there is substituted –
“indoor physical activity facility” means a building or other indoor
place that is used, whether predominantly or occasionally, for sport, dance or
exercise, including a squash court, indoor sport court, gymnasium, trampoline
centre, bowling alley, climbing wall, dance or yoga studio or any other
building or place of a like character used for those physical activities;”;
(b) the definition
“recreation” is deleted.
3 Article 2 (closure of certain workplaces) amended
(1) In
Article 2(1) –
(a) sub-paragraphs (b),
(c) and (j) are deleted;
(b) after sub-paragraph (e)
there is inserted –
“(ea) indoor changing and shower
facilities used in connection with indoor physical activity facilities or outdoor
sport or exercise;”;
(c) for sub-paragraph (h) there is substituted –
“(h) indoor play areas;”.
(2) In
Article 2(2) –
(a) in the definition
“entertainment facility” after “means” there is inserted “the auditorium of”;
(b) after the definition
“entertainment facility” there is inserted –
“indoor play area” includes any part of a workplace used for soft
play, play that involves the use of play equipment such as climbing frames, swings,
ropes, slides or a ball pit or dressing up.”.
(3) In
Article 2(3)(b) after “registered person” there is inserted “within the
meaning of Article 3(6)”.
(4) Article 2(4)
is deleted.
4 Article 3 (specified workplaces open to the public for
certain purposes) amended
(1) In
Article 3(1) –
(a) sub-paragraphs (c), (d) and (e) are deleted;
(b) for sub-paragraph (f) there is substituted –
“(f) indoor physical activity
facilities for a purpose specified in paragraph (2A);”;
(c) for sub-paragraph (g) there is substituted –
“(g) visitor attractions,
except to the extent closed by another provision of this Order.”.
(2) After
Article 3(2) there is inserted –
“(2A) Workplaces that are indoor physical activity
facilities may be open only for the following purposes –
(b) for gatherings mentioned
in Article 8(1) of the Covid‑19 (Gathering Control) (Jersey) Order 2020[4] (exception: certain
gatherings involving young people);
(c) for the provision of a
therapeutic service that is provided –
(i) by a doctor or a
registered person, or
(ii) by another person on a
referral from a doctor or from a registered person;
(d) in the case of a facility
consisting of an indoor riding arena, for the purpose of exercising or riding a
horse provided that no more than one person is present in the arena at any one
time.”.
(3) In
Article 3(5)(a) after “first aid” there is inserted “or a vaccine against
any disease”.
(4) In
Article 3(6) the definition “permitted shop” is deleted and the following
definition is inserted –
“ “registered
person” means a person registered under the Health Care (Registration) (Jersey)
Law 1995[5], who is acting in
the course of that person’s registrable occupation.”.
5 Article 5 (visitors required to wear masks) amended
In Article 5(3) –
(a) for sub-paragraph (i) there is substituted –
“(i) indoor physical activity
facilities, for the purposes mentioned in Article 3(2A)(a)
and (c);”;
(b) after sub-paragraph (j)
there is inserted –
“(k) auction houses;
(l) betting agencies.”.
6 Article 5A (condition of opening: workers wearing masks or
visors) amended
In Article 5A –
(a) for paragraph (2)(g)
there is substituted –
“(g) indoor physical activity
facilities;”;
(b) for paragraph (2A) there
is substituted –
“(2A) In
the case of retail premises, the requirement in paragraph (1) applies
additionally while the worker is in the presence of a person working as part of
a different workforce to the worker.”.
7 Article 5C (condition of opening: distancing in workplaces)
amended
In Article 5C(2) –
(a) for sub-paragraph (f)
there is substituted –
“(f) indoor physical activity facilities,
for the purpose mentioned in Article 3(2A)(a);”;
(b) after sub-paragraph (g)
there is inserted –
“(h) auction houses;
(i) betting agencies.”.
8 Covid-19 (Gathering Control) (Jersey) Order 2020 amended
For Article 8(1)(a)
of the Covid-19 (Gathering Control) (Jersey) Order 2020[6] there is
substituted –
“(a) a gathering for the
purposes of –
(i) education or before or
after school activity provided by a school, or
(ii) registered day care of
children,
including for the purposes of travel in connection with that
education, activity or registered day care;”.
9 Citation and commencement
This Order may be cited as the Covid-19 (Workplace Restrictions and
Gathering Control) (Amendment) (Jersey) Order 2021 and comes into force on 3rd
February 2021.
