1. LAWS ADOPTED BY THE STATES

(a)    Criminal Justice (Miscellaneous Provisions) (No 3) (Jersey) Law 201-

This Law makes miscellaneous amendments regarding evidence in criminal proceedings.

(b)   Criminal Justice (International Co-operation) (Amendment No 2) (Jersey) Law 201-

        (P.181/2011—adopted in 3rd reading, 17.1.12)

This Law confers powers of search on customs officers in cases where information relating to an offence concerning a customs matter has been requested by another country or territory.

(c)   Loi sur l’Association dite “The Jersey Football Association” (Repeal) (Jersey) Law 201-

        (P.21/2012—adopted in 3rd reading, 17.4.12)

This Law provides for the repeal of the Loi (1952) accordant un Acte d’Incorporation à l’Association dite “The Jersey Football Association” and the transfer of the assets and liabilities to the Jersey Football Association Ltd.

(d)   Loi (201-) (Amendement No 2) sur l’atténuation des peines et sur la mise en liberté surveillée

This Law makes it clear that a person appointed as a probation officer is appointed not only to discharge functions under the Law being amended but also under any other enactment that confers powers on probation officers.

(a)    Shipping (MARPOL) (Jersey) Regulations 2012

These Regulations implement Annexes I and II of the International Convention for the Prevention of Pollution from Ships.

(b)   Employment (Minimum Wage) (Amendment No 8) (Jersey) Regulations 2012

These Regulations revise amounts to be taken into account in determining the value of an employee’s remuneration.

(c)   Cold Weather Bonus (Jersey) Regulations 2012

        (R&O.9/2012—in force 19.1.12)

These triennial Regulations confer an entitlement to a cold weather bonus on households that are entitled to a bonus under the Food Costs Bonus (Jersey) Regulations 2011.

(d)   Policing of Beaches (Amendment No 10) (Jersey) Regulations 2012

        (R&O.18/2012—in force 1.3.12)

These Regulations make miscellaneous amendments to the Policing of Beaches (Jersey) Regulations 1959, including an amendment to facilitate the holding of equine events on beaches at times when riding would otherwise be prohibited.

(e)    States of Jersey (Transfer of Functions No 5) (Economic Development to Chief Minister) (Jersey) Regulations 2012

These Regulations transfer functions under the Aviation Security Act 1982, as extended to Jersey, from the Minister for Economic Development to the Chief Minister.

These Regulations revise the functions of the Director of Civil Aviation.

These Regulations make miscellaneous amendments to the Social Security (Jersey) Law 1974 concerning contribution factors and contribution rates.

These Regulations amend miscellaneous enactments consequentially upon the commencement of the Civil Partnerships (Jersey) Law 2012.

(a)    Civil Contingencies (Bailiwick of Guernsey) Law, 2012

        (Billet d’État No IV of 2012. Approved 21.02.12)

This Law provides powers in relation to monitoring risks and contingency planning and to enable action to be taken in certain circumstances to prevent a threat from becoming an emergency and to make regulations dealing with an emergency affecting the Bailiwick or any part of it. It also repeals the Emergency Powers (Bailiwick of Guernsey) Law, 1965 and creates the Civil Contingencies Authority to replace the Emergency Powers Authority. It is based in large part on the UK’s Civil Contingencies Act 2004, pursuant to the relevant States Resolution.

(b)   Regulation of Health Professions (Enabling Provisions) (Guernsey) Law, 2012

This Law confers powers on the States of Deliberation to make Ordinances concerning the health professions, persons connected to these professions and persons who purport to practise or to be qualified to practise these professions.

(c)   Sea Fish Licensing (Bailiwick of Guernsey) Law, 2012

        (Billet d’État No V of 2012. Approved 06.03.12)

This Law prohibits fishing within Bailiwick fishery limits by British fishing boats unless authorised by a licence granted by the States of Guernsey Commerce and Employment Department; creates powers of entry, search and seizure for British sea-fishery officers and creates penalties for its infringement. The Law also repeals the Sea Fish Licensing (Guernsey) Ordinance, 2003.

(d)   Wireless Telegraphy and Related Matters (Deemed Registration and Validation) (Bailiwick of Guernsey) Law, 2012

This Law deems certain United Kingdom statutory instruments to have been registered in the Royal Court and validates certain acts done under them.

(e)    Forfeiture of Money, etc in Civil Proceedings (Bailiwick of Guernsey) (Amendment) Law, 2012

This Law amends the Forfeiture of Money, etc in Civil Proceedings (Bailiwick of Guernsey) Law, 2007 by, amongst other things, inserting provision categorising proceedings under the Law as civil proceedings.

(f)         Mont Varouf School (Guernsey) Law, 2012

        (Billet d’État No V of 2012. Approved 06.03.12)

The Law will transfer to and vest in the Constables for the time being of the Parish of Saint Saviour and the States of Guernsey land and premises known as Mont Varouf School upon terms and conditions agreed between the Constables and the States.

This Ordinance specifies the agreements providing for the obtaining and exchanging of information in relation to tax, made between the States of Guernsey and the Governments of the—

        (a) Czech Republic, signed on 15 September 2011, and

        for the purposes of the Income Tax (Guernsey) Law, 1975.

(b)   Terrorist Asset-Freezing (Bailiwick of Guernsey) Law, 2011 (Commencement) Ordinance, 2012

This Ordinance commences the Terrorist Asset-Freezing (Bailiwick of Guernsey) Law, 2011 on 25 January 2012.

(c)   Animal Welfare (Guernsey) Ordinance, 2012

This Ordinance updates and consolidates legislation in Guernsey relevant to animal welfare. In particular it updates relevant offences against animals, provides for a new duty of care for animal owners and keepers, a new licensing requirement for certain activities carried on in relation to animals and for enhanced penalties, including court orders, in relation to relevant offences.

(d)   Housing (Control of Occupation) (Amendment of Housing Register) Ordinance, 2012

This Ordinance authorises the Housing Authority to inscribe in Part A of the Housing Register the dwellings known as “1 Mont Havelet Court”, “2 Mont Havelet Court”, and “3 Mont Havelet Court”, 1 St George Road, Saint Peter Port.

The Law amends the Tourism (Sark) Law, 1982 so as to change the period of validity, and procedure for renewal, of accommodation permits granted under the Law. The Law also provides for powers to make future changes to such provisions by Ordinance of the Chief Pleas of Sark and for the extension of accommodation permits by regulations.
