1. LAWS ADOPTED BY THE STATES

 (a)   States of Jersey Police Force Law 201-

        (P.182/2011—adopted in 3rd reading, 15.5.12)

This Law provides for the administration and supervision of the States of Jersey Police Force and establishes the Jersey Police Authority.

(b)   Connétables (Miscellaneous Provisions) (Jersey) Law 201-

        (P.36/2012—adopted in 3rd reading, 16.5.12)

This Law repeals the policing functions of the Connétables and enables a Procureur du Bien Public to deputise for a Connétable in certain circumstances.

(c)   Money Laundering and Weapons Development (Directions) (Amendment) (Jersey) Law 201-

        (P.41/2012—adopted in 3rd reading, 29.5.12)

This Law revises the rights available to a person aggrieved by a decision of the Chief Minister under the Money Laundering and Weapons Development (Directions) (Jersey) Law 2012.

(d)   Collective Investment Funds (Amendment and Validation) (Jersey) Law 201-

(P.42/2012—adopted in 3rd reading, 29.5.12)

This Law validates certain fees collected under the Collective Investment Funds (Jersey) Law 1988 in relation to unclassified funds and provides for such fees to be set by the Jersey Financial Services Commission in the future.

(e)    Petroleum (Amendment No 3) (Jersey) Law 201-

        (P.52/2012—adopted in 3rd reading, 10.7.12)

        This Law revises the definition “petroleum-spirit” in the Petroleum (Jersey) Law 1984.

(f)         Fire Precautions (Amendment No 2) (Jersey) Law 201-

        (P.54/2012—adopted in 3rd reading, 10.7.12)

        This Law provides for a fire certificate to remain in force for 3 years and requires there to be a “responsible person” for premises that require a fire certificate.

4. REGULATIONS MADE BY THE STATES

(a)    Policing of Parks (Amendment No 4) (Jersey) Regulations 2012

        These Regulations broaden the descriptions of dog that may be taken into a park to assist a disabled person, so as to include a dog trained to assist a deaf person or any other disabled person.

(b)   Harbours (Inshore Safety) (Jersey) Regulations 2012

        (R&O.64/2012—in force 23.5.12)

        These Regulations replace the Boats and Surf-Riding (Control) (Jersey) Regulations 1969.

(c)   Health Insurance (Medical Benefit) (Amendment No 5) (Jersey) Regulations 2012

        These Regulations increase the general rate of medical benefit from £19.59 to £20.28.

(d)   Employment Tribunal (Amendment No 3) (Jersey) Regulations 2012

        These Regulations provide for the appointment of up to 5 Deputy Chairmen of the Jersey Employment Tribunal.

        These Regulations extend the application of the Petroleum (Jersey) Law 1984 to further descriptions of petroleum-spirit.

(f)        Income Support (Amendment No 8) (Jersey) Regulations 2012

        These Regulations increase, by approximately 3.5%, rates payable in respect of components of income support.

(a)    Financial Services Commission (Bailiwick of Guernsey) (Amendment) Law, 2012

This Law amends s 2 of the Financial Services Commission (Bailiwick of Guernsey) Law, 1987 by inserting a sub-section relating to the Commission’s functions to act as protector of the charitable trust declared on 6 June 1996 by which the Finance Training Agency was constituted and to fund and support the GTA University.

(b)   Foundations (Guernsey) Law, 2012

This Law provides for the creation of a new type of legal person to be known as a foundation and sets out the structure of foundations, details the necessary documents and officials and specifies the duties of the officials and the entitlements of any beneficiaries. The Schedules to the Law contain the mechanics of establishment, registration (including the powers of the registrar), disqualification, migration and termination of a foundation.

(a)    Merchant Shipping (Oil Pollution) (Bunkers Convention) (Bailiwick of Guernsey) Ordinance, 2012

This Ordinance gives domestic effect to the International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001, which ensures that adequate, prompt and effective compensation is available to persons who suffer damage caused by spills of oil, when carried as fuel in ships’ bunkers. The Convention also allows for a claim for compensation for pollution damage to be brought directly against the insurer.

(b)   Pilotage (Amendment) Ordinance, 2012

This Ordinance amends the Pilotage Ordinance, 1967, to permit Pilotage Assessors to be appointed by the Pilotage Board in place of the Royal Court.

(c)   Guernsey Competition and Regulatory Authority Ordinance, 2012

This Ordinance establishes the Guernsey Competition and Regulatory Authority and confers upon it various functions and powers which will enable it, amongst other things, to investigate and regulate anti-competitive practices and mergers and acquisitions. The Ordinance transfers the functions of the Director General of Utility Regulation and the undertaking, property and liabilities of the Director, and of the Office of Utility Regulation, to the newly established Authority and makes a number of consequential changes to the Regulation of Utilities (Bailiwick of Guernsey) Law, 2001, the Electricity (Guernsey) Law, 2001 and the Telecommunications (Bailiwick of Guernsey) Law, 2001.

(d)   Post Office (Bailiwick of Guernsey) (Amendment) Ordinance, 2012

This Ordinance makes a number of amendments to the Post Office (Bailiwick of Guernsey) Law, 2001. In particular, it inserts provision into the Law enabling the Guernsey Competition and Regulatory Authority (as created under the Guernsey Competition and Regulatory Authority Ordinance, 2012) to grant an exemption from the requirement to hold a licence in order to provide postal services. It inserts provision expanding the powers of the Authority to impose licence conditions. It also removes the power of the Director-General of Utility Regulation (now to be the Guernsey Competition and Regulatory Authority) to set the reserved area (within which operators are required to be licensed) himself, and makes all postal service providers subject to licensing (with various de minimis exceptions).

(e)    Regulation of Utilities (States’ Directions) (Bailiwick of Guernsey) Ordinance, 2012

This Ordinance is made under the Regulation of Utilities (Bailiwick of Guernsey) Law, 2001, and gives directions to the Director General of Utility Regulation. The directions require the Director General to follow the six principles for economic regulation as set out in the schedule to the Ordinance, and require the Director General to prepare a Memorandum of Understanding concerning the future regulation of Guernsey Post Limited and Guernsey Electricity Limited.

(f)         Income Tax (Guernsey) (Amendment) Ordinance, 2012

This Ordinance amends the Income Tax (Guernsey) Law, 1975 to ensure that a wife’s income is not treated as that of her husband’s in circumstances where he is not receiving the higher personal allowance for married persons and in such other circumstances as may be prescribed by resolution of the States or Regulation of the Treasury and Resources Department. The Ordinance also repeals s 75CA of the Law (scrutiny of requests for information under TIEA’s), which had not ever been commenced.

(g)   Income Tax (Exempt Bodies) (Guernsey) (Amendment) Ordinance, 2012

This Ordinance amends the Income Tax (Exempt Bodies) (Guernsey) Ordinance, 1989, to ensure that any entity or legal arrangement which is a body for the purposes of the Income Tax Law, and which is concerned with a collective investment scheme is capable of gaining exemption from income tax, provided it is established for the purposes of undertaking collective investment, or is in the beneficial ownership of such a body.

(h)   Income Tax (Guernsey) (Approval of Agreements with India, Japan, Poland, Seychelles and St Kitts and Nevis) Ordinance, 2012

This Ordinance specifies the agreements providing for the obtaining and exchanging of information in relation to tax, made between the States of Guernsey and the Governments of—

        (a)    Japan, signed on 6 December, 2011,

        (b)   the Republic of Poland, signed on 6 December, 2011,

        (c)   the Republic of India, signed on 20 December, 2011,

    (d)   the Republic of the Seychelles, signed on 20 December, 2011, and

        (e)    the Federation of Saint Kitts and Nevis, signed on 18 January, 2012 and 7 February, 2012 on behalf of the Federation and Guernsey respectively,

        for the purposes of the Income Tax (Guernsey) Law, 1975.

(i)     Renewable Energy (Guernsey) Law, 2010 (Commencement) Ordinance, 2012

This Ordinance commences s 2 and Parts II, IV and V of the Renewable Energy (Guernsey) Law, 2010.

(j)     Supplementary Benefit (Implementation) (Amendment) Ordinance, 2012

This Ordinance amends the Supplementary Benefit (Implementation) Ordinance, 1971 in order to provide that certain allowances, paid by the States Health and Social Services Department in respect of children who have been adopted or are subject to residence orders, are disregarded for the purpose of calculation of entitlement to supplementary benefit.

(k)   Child Protection (Amendment) (Guernsey) Ordinance, 2012

This Ordinance amends s 15 of the Child Protection (Guernsey) Law, 1972, such that the obligation of the States Health and Social Services Department to register certain premises where children are looked after, only applies in respect of premises that take in children under five years of age.

(l)     Vehicular Traffic (Control of Parking on Certain States Land) (Amendment) Ordinance, 2012

This Ordinance amends the Vehicular Traffic (Control of Parking on Certain States Land) Ordinance, 1988, to permit the designation of unloading bays at the Salerie Battery car park in St Peter Port.

This Ordinance commences the Criminal Justice (Minimum Terms for Sentences of Life Imprisonment) (Bailiwick of Guernsey) Law, 2011 on 27 June 2012.

(o)   Competition (Guernsey) Ordinance, 2012

This Ordinance is made under the Competition (Enabling Provisions) (Guernsey) Law, 2009 and introduces measures prohibiting the abuse of a dominant market position by undertakings, controlling anti-competitive practices by undertakings and regulating certain mergers and acquisitions. It empowers the Guernsey Competition and Regulatory Authority to investigate anti-competitive practices and mergers and acquisitions and creates enforcement powers for the Authority, where it decides that an undertaking is in contravention of certain provisions of the Law.

(p)   Housing (Control of Occupation) (Amendment of Housing Register) (No 2) Ordinance, 2012

This Ordinance authorises the Housing Authority to inscribe in Part B of the Housing Register the dwelling known as “the Longfrie Inn”, Route de Longfrie, Saint Pierre du Bois.

This Law amends the Companies (Alderney) Law, 1994 by inserting provision requiring certain Alderney companies to have a resident agent who is either, an individual resident in Alderney who is a director of the company, or a corporate services provider. Additional inserted provisions set out the obligations of a company to keep a record of its resident agent and prescribe the duties of a resident agent including the duty to ascertain and record the identity of the persons who are beneficial owners of members' interests in the company and the circumstances in which, and persons and bodies to whom, a resident agent must disclose beneficial ownership information.
