This Law repeals the policing functions of
the Connétables and enables a Procureur du Bien Public to deputise for a
Connétable in certain circumstances.

Laundering and Weapons Development (Directions) (Amendment) (Jersey) Law 201-

in 3rd reading, 29.5.12)
This Law revises the rights available to a
person aggrieved by a decision of the Chief Minister under the Money Laundering
and Weapons Development (Directions) (Jersey) Law 2012.
(d) Collective
Investment Funds (Amendment and Validation) (Jersey) Law 201-

This Law validates certain fees collected
under the Collective Investment Funds (Jersey)
Law 1988 in relation to unclassified funds and provides for such fees to be set

This Law
amends s 2 of the Financial Services Commission (Bailiwick of Guernsey) Law,
1987 by inserting a sub-section relating to the Commission’s functions to
act as protector of the charitable trust declared on 6 June 1996 by which the
Finance Training Agency was constituted and to fund and support the GTA University.

This Law
provides for the creation of a new type of legal person to be known as a
foundation and sets out the structure of foundations, details the necessary
documents and officials and specifies the duties of the officials and the
entitlements of any beneficiaries. The Schedules to the Law contain the
mechanics of establishment, registration (including the powers of the
registrar), disqualification, migration and termination of a foundation.

This Ordinance
gives domestic effect to the International Convention on Civil Liability for
Bunker Oil Pollution Damage, 2001, which ensures that adequate, prompt and
effective compensation is available to persons who suffer damage caused by
spills of oil, when carried as fuel in ships’ bunkers. The Convention
also allows for a claim for compensation for pollution damage to be brought
directly against the insurer.

This Ordinance amends the Pilotage Ordinance, 1967, to permit
Pilotage Assessors to be appointed by the Pilotage Board in place of the Royal Court.
(c) Guernsey
Competition and Regulatory Authority Ordinance, 2012

This Ordinance
establishes the Guernsey Competition and Regulatory Authority and confers upon
it various functions and powers which will enable it, amongst other things, to
investigate and regulate anti-competitive practices and mergers and acquisitions.
The Ordinance transfers the functions of the Director General of Utility
Regulation and the undertaking, property and liabilities of the Director, and
of the Office of Utility Regulation, to the newly established Authority and
makes a number of consequential changes to the Regulation of Utilities
(Bailiwick of Guernsey) Law, 2001, the Electricity (Guernsey) Law, 2001 and the
Telecommunications (Bailiwick of Guernsey) Law, 2001.

Office (Bailiwick of Guernsey) (Amendment) Ordinance, 2012

This Ordinance
makes a number of amendments to the Post Office (Bailiwick of Guernsey) Law,
2001. In particular, it inserts provision into the Law enabling the Guernsey
Competition and Regulatory Authority (as created under the Guernsey Competition
and Regulatory Authority Ordinance, 2012) to grant an exemption from the
requirement to hold a licence in order to provide postal services. It inserts
provision expanding the powers of the Authority to impose licence conditions. It
also removes the power of the Director-General of Utility Regulation (now to be
the Guernsey Competition and Regulatory Authority) to set the reserved area
(within which operators are required to be licensed) himself, and makes all
postal service providers subject to licensing (with various de minimis exceptions).

This Ordinance
is made under the Regulation of Utilities (Bailiwick of Guernsey) Law, 2001,
and gives directions to the Director General of Utility Regulation. The
directions require the Director General to follow the six principles for
economic regulation as set out in the schedule to the Ordinance, and require
the Director General to prepare a Memorandum of Understanding concerning the
future regulation of Guernsey Post Limited and Guernsey Electricity Limited.

This Ordinance
amends the Income Tax (Guernsey) Law, 1975 to
ensure that a wife’s income is not treated as that of her husband’s
in circumstances where he is not receiving the higher personal allowance for
married persons and in such other circumstances as may be prescribed by
resolution of the States or Regulation of the Treasury and Resources
Department. The Ordinance also repeals s 75CA of the Law (scrutiny of
requests for information under TIEA’s), which had not ever been
commenced.

This Ordinance
amends the Income Tax (Exempt Bodies) (Guernsey) Ordinance, 1989, to ensure
that any entity or legal arrangement which is a body for the purposes of the
Income Tax Law, and which is concerned with a collective investment scheme is
capable of gaining exemption from income tax, provided it is established for
the purposes of undertaking collective investment, or is in the beneficial
ownership of such a body.

position by undertakings, controlling anti-competitive
practices by undertakings and regulating certain mergers and acquisitions. It
empowers the Guernsey Competition and Regulatory Authority to investigate
anti-competitive practices and mergers and acquisitions and creates enforcement
powers for the Authority, where it decides that an undertaking is in
contravention of certain provisions of the Law.
