Road Traffic (Saint Helier) (Amendment No. 16) (Jersey) Order 2004

THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, in pursuance of Articles 33, 33A, 33B and 42 of the Road Traffic (Jersey) Law 1956,[1] and after consultation with the Connétable of St. Helier, orders as follows –

1        Interpretation

In this Order, “principal Order” means the Road Traffic (Saint Helier) (Jersey) Order 1996.[2]

2        Article 3 amended

Article 3 of the principal Order is amended by inserting after paragraph (1) the following paragraph –

“(1A) Paragraph (1) shall not apply to a type of vehicle specified in the second column of Part III of the First Schedule in relation to a road, or a part of a road, specified opposite in the first column of that Part of the Schedule.”.

3        Article 7 amended

In Article 7 of the principal Order –

(a)     in paragraph (d) for the words “gully cleaning.” there shall be substituted the words “gully cleaning; or”;

(b)     there shall be added at the end the following paragraph –

“(e)    if the vehicle is a bicycle.”.

4        First Schedule amended

In the First Schedule to the principal Order –

(a)     in Part I after the item “Oxford Road (between Stopford Road and Byron Road)” in the first column and the entry in the second column opposite that item there shall be inserted the following item and entry –

“Oxford Road (between Stopford Road and a point 10 yards south)

A point 10 yards south of Stopford Road to Stopford Road”;

(b)          at the end there shall be added the following Part –

5        Fourth Schedule amended

In the Fourth Schedule to the principal Order –

(a)     for the first entry in the second column opposite the item “Don Street” in the first column there shall be substituted the following entries –

“East side (between the pedestrian precinct and a point 14 yards south of the southern boundary of Waterloo House)

East side (between a point 7 yards north of the southern boundary of Waterloo House and Burrard Street)”;

(b)     for the third and fourth entries in the second column opposite the item “Don Street” in the first column there shall be substituted the following entry –

“West side (between the pedestrian precinct and the southern boundary of No. 33)”;

(c)     for the entry in the second column opposite the item “La Pouquelaye” in the first column there shall be substituted the entry “Both sides”;

(d)     for the first entry in the second column opposite the item “Patriotic Street” in the first column there shall be substituted the following entries –

“East side (between the Esplanade and Patriotic Place)

East side (between Patriotic Place and a point 16 yards north of Patriotic Place)

East side (between a point 30 yards north of Patriotic Place and Newgate Street)”.

6        Sixth Schedule amended

In the Sixth Schedule to the principal Order –

(a)     in Part I, for the entry in the second column opposite the item “Peirson Place” in the first column and the entry in the second column opposite the item relating to “Royal Square” there shall be substituted the entry “at all times”;

(b)     in Part II, the entry “Peirson Place” in the first column and the item in the second column opposite that entry and the entry relating to “Royal Square” in the first column and the item in the second column opposite that entry shall be deleted;

(c)     for Part III there shall be substituted the following Part –

Cabs, as defined in the Motor Traffic Law (between 7 p.m. and 10 a.m. the following day); minibuses for the disabled; pedal cycles

New Street (between the northern boundary of No. 8 New Street and Union Street)

Cabs, as defined in the Motor Traffic Law (between 7 p.m. and 10 a.m. the following day); vehicles used by disabled persons; minibuses for the disabled; vehicles accessing off-street vehicular facilities; pedal cycles

Vine Street

Jurats’ vehicles (Monday to Friday); vehicles used by disabled persons (Saturdays and Sundays)”.

7        Eighth Schedule amended

In the Eighth Schedule to the principal Order –

(a)     in Part I –

(i)      for the entry in the second column opposite the item “Caledonia Place” in the first column there shall be substituted the following entry –

“East side (between a point 25 yards north of La Route du Fort and a point 26 yards further north)”,

(ii)      the item and entries relating to the Esplanade shall be deleted;

(b)     in Part II –

(i)      for the second entry in the second column opposite the item “Don Street” in the first column there shall be substituted the following entry –

“West side (between a point 18 yards north of the southern boundary of No. 33 and Burrard Street)”,

(ii)      after the item “Dumaresq Street” in the first column and the entry in the second column opposite that item there shall be inserted the following item and entries –

“Esplanade

North side (between a point 23 yards east of the eastern boundary of Marina Court and a point 10 yards west of Payn Street)

 

North side (between a point 3 yards east of the western boundary of No. 22 and the western boundary of No. 17)

 

North side (between the eastern boundary of No. 17 and the western boundary of No. 10)

 

North side (between a point 9 yards east of the western boundary of No. 10 and a point 9 yards east of the western boundary of No. 9)

 

North side (between a point 19 yards east of the western boundary of No. 9 and a point 19 yards west of Conway Street)”,

(iii)     in the first entry in the second column opposite the item “Hilary Street” in the first column, for the words “21 yards” there shall be substituted the words “15 yards”;

(c)     in Part IIA for the second entry in the second column opposite the item “St. Marks Road” in the first column there shall be substituted the following entry –

“North side (from its junction with Oxford Road westwards for a distance of 17 yards)”.

8        Ninth Schedule amended

In the Ninth Schedule to the principal Order, in Part II, for the first entry in the second column opposite the item “St. Mark’s Road” in the first column there shall be substituted the following entry –

“North side (from its junction with Byron Road east to a point 17 yards from its junction with Oxford Road).”.

9        Tenth Schedule amended

In the Tenth Schedule to the principal Order, in Part I –

(a)     after the item “Castle Street” in the first column and the entries in the columns opposite that item there shall be inserted the following items and entries –

“La Colomberie

North side (from its junction with Snow Hill, east for a distance of 16 yards)

20 minutes

2 a.m. to 6 p.m.

Don Street

East side (between a point 7 yards south of the southern boundary of Waterloo House and a point 14 yards further north)

20 minutes

2 a.m. to 6 p.m.”;

(b)     after the item “Halkett Place” in the first column and the entries in the columns opposite that item there shall be inserted the following item and entries –

“Hill Street

North side (between a point 35 yards west of its junction with Snow Hill and a point 15 yards further west)

20 minutes

2 a.m. to 6 p.m.”;

(c)     after the item “Kensington Place” in the first column and the entries in the columns opposite that item there shall be inserted the following items and entries –

“La Motte Street

South side (from its junction with Snow Hill, east for a distance of 14 yards)

20 minutes

2 a.m. to 6 p.m.

Patriotic Street

South side (between a point 16 yards north of Patriotic Place and a point 14 yards further north)

20 minutes

All times.”.

10      Eleventh Schedule amended

In the Eleventh Schedule to the principal Order –

(a)     after the item “Columbus Street” in the first column and the entry in the second column opposite that item there shall be inserted the following item and entry –

“Don Street

East side (between a point 7 yards south of the southern boundary of Waterloo House and a point 7 yards further south)”;

(b)     in the entry in the second column opposite the item “Hilary Street” in the first column, for the words “28 yards” and “13 yards” there shall be substituted the words “22 yards” and “19 yards” respectively.

11      Citation and commencement

This Order may be cited as the Road Traffic (Saint Helier) (Amendment No. 16) (Jersey) Order 2004 and shall come into force on 23rd June 2004.
