Road Traffic (Saint Helier) (Amendment No. 13) (Jersey) Order 2003

THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, in pursuance of Articles 33, 33A, 33B and 42 of the Road Traffic (Jersey) Law 1956,[1] and after consultation with the Connétable of St. Helier, orders as follows –

1        Interpretation

In this Order “the principal Order” means the Road Traffic (Saint Helier) (Jersey) Order 1996.[2]

2        Article 2 amended

In Article 2 of the principal Order there shall be inserted the following definitions in their proper alphabetical positions –

“ ‘at night’ means at any time between the hours of 5 p.m. on any day and 8 a.m. on the following day;

Committee’ means the Environment and Public Services Committee;

keep’ means to keep for one’s own use;

residential and business parking zone’ and ‘zone’ mean the area lying within and bounded by the blue line in the map set out in Part I of the Ninth Schedule; and

resident’s parking permit’ and ‘permit’ mean a permit issued under Article 7 of this Order by the Committee;”.

3        Article 11 amended

(1)     In Article 11 of the principal Order for the words “The roads specified in Parts I and II of the Eighth Schedule” there shall be substituted the words “Subject to Article 29, the roads specified in Parts I, II and IIA of the Eighth Schedule”.

(2)     In Article 11(2) of the principal Order after the figure “2002,” there shall be inserted the words “and to Article 29,”.

4        Article 12 amended

(1)     In Article 12(3) of the principal Order there shall be inserted at the beginning the words “Subject to Article 29,”.

(2)     In Article 12(4) of the principal Order there shall be inserted at the beginning the words “Except for a vehicle which is parked in accordance with Article 29,”.

(3)     In Article 12(8) of the principal Order after the words “a paying parking place” there shall be inserted the words “or a parking place specified in Part II of the Ninth Schedule”.

5        Article 13 amended

(1)     In Article 13(1) of the principal Order after the words “a paying parking place” there shall be inserted the words “or a parking place specified in Part II of the Ninth Schedule”.

(2)     In Article 13(2) of the principal Order after the words “any paying parking place” there shall be inserted the words “or a parking place specified in Part II of the Ninth Schedule”.

6        Article 14 amended

In Article 14 of the principal Order there shall be inserted at the beginning the words “Subject to Article 29,”.

7        Article 15 amended

In Article 15(1) of the principal Order –

(a)     there shall be inserted at the beginning the words “Subject to Article 29,”; and

(b)     the word “and” at the end of sub-paragraph (a) shall be revoked and after that sub-paragraph there shall be inserted the following sub-paragraph –

“(aa)  if the vehicle is parked in a paying parking place specified in Part IIA of the Eighth Schedule, one parking unit for each period of two hours or part thereof; and”.

8        Part IV inserted

After Part III of the principal Order the following Part shall be inserted –

“PART IV

RESIDENTIAL AND BUSINESS PARKING

28      Interpretation

In this Part ‘business’ means a business on one’s own account.

29      Parking in the residential and business parking zone

(1)     A vehicle shall not be parked at any time in a parking place specified in Part II of the Ninth Schedule unless –

(a)     a resident’s parking permit is in effect in respect of that vehicle; and

(b)     the vehicle is displaying the permit,

or if it is parked with the permission in writing of the Connétable.

(2)     Notwithstanding the provisions of Articles 11, 12, 14 and 15, a vehicle may be left –

(a)     for any period during a Saturday or a Sunday; and

(b)     between the hours of 5 p.m. and 9 a.m. on any other day,

in a paying parking place specified in Part IIA of the Eighth Schedule which is within the zone if –

(i)      a permit is in effect in respect of that vehicle, and

(ii)      the vehicle is displaying the permit,

or if it is parked with the permission in writing of the Connétable.

(3)     Notwithstanding the provisions of Article 11, a vehicle which is not displaying a permit may not be parked in a paying parking place specified in Part IIA of the Eighth Schedule which is within the zone between the hours of 10 p.m. and 9.a.m. on any day.

29A   Applications for permits

A person who –

(a)     resides or has a business in the zone; and

(b)     keeps a vehicle in Jersey,

may apply in writing to the Committee for a permit for that vehicle.

29B   Restrictions on issue of permits

(1)     A person may not hold more than one permit at the same time.

(2)     A permit is not transferable to any other person.

29C   Fees for permit

The fee payable for a permit shall be £150.

29D   Form of permit

(1)     Subject to paragraph (2) a permit shall be in the form specified from time to time by the Director of Traffic and Transportation.

(2)     A permit shall specify –

(a)     the registration number of the vehicle for which the permit is issued;

(b)     the date on which the permit begins to have effect; and

(c)     the date on which the permit expires.

29E   Issue of permit

(1)     Subject to paragraphs (2) and (3) on payment of the fee the Committee shall issue to the applicant the permit requested.

(2)     The Committee may refuse to issue a permit if there would be insufficient parking places in the zone for all permit holders.

(3)     In deciding whether or not to issue a permit the Committee may give preference to an applicant who is the holder of a disabled person’s badge issued under the Road Traffic (Disabled Persons) (Badges for Motor Vehicles) (Jersey) Order 1982.[3]

29F   Duration of permit

(1)     A permit shall cease to have effect –

(a)     if the permit holder does not reside in the zone and does not have a business in the zone; or

(b)     if the permit holder ceases to keep the vehicle for which the permit is issued.

(2)     If a permit ceases to have effect, the permit holder shall surrender it to the Committee within 10 days.

29G   Change of vehicle

If a permit holder –

(a)     applies to the Committee in writing for the issue of a permit for any other vehicle kept by the holder; and

(b)     surrenders the permit to the Committee,

the Committee shall issue to the holder without further charge a permit for that other vehicle, for the unexpired period of the permit surrendered.

29H   Refunds

(1)     If a permit ceases to have effect by reason of the circumstances to which Article 29F(1) refers, and the permit holder surrenders the permit to the Committee, it shall refund to the holder a proportion of the fee for the unexpired period of the permit calculated in accordance with paragraph (2).

(2)     The amount to be refunded shall be the proportion of the fee paid by the permit holder that the number of months that have not commenced in the period for which it was issued bears to the total number of months in that period (including the month in which it was issued), less an administration charge of £10.

29I    Change of address

If a permit holder changes his residential address in the zone, or his business address in the zone, he shall inform the Committee in writing within 10 days.”.

9        First Schedule amended

In Part I of the First Schedule to the principal Order for the item and entry relating to La Pouquelaye there shall be substituted the following item and entry –

 

“La Pouquelaye (between Rouge Bouillon and a point 82 yards south of the southern entrance to Manor Park Road

Rouge Bouillon to a point 82 yards south of the southern entrance to Manor Park Road”.

10      Second Schedule amended

In Part III of the Second Schedule to the principal Order for the item and entry relating to “All vehicles except omnibuses and cycles” there shall be substituted the following item and entries –

 

“All vehicles except omnibuses and cycles

The Parade (North side of Union Street)

The Parade (South side of Union Street)”.

11      Fourth Schedule amended

In the Fourth Schedule to the principal Order –

(a)     for the second entry to the item relating to Ann Street there shall be substituted the words “East side (between its junction with Charles Street and a point 82 yards north)”;

(b)     for the fourth entry to the item relating to Ann Street there shall be substituted the words “West side (between a point 67 yards north of its junction with Charles Street and its junction with Belmont Road)”;

(c)     in the first and second entries to the item relating to Dumaresq Street for the words “Morgan Grenfell (Jersey) Limited” wherever they appear there shall be substituted the words “No. 12”;

(d)     for the fifth entry to the item relating to Gloucester Street there shall be substituted the words “South side (from the Parade, west, to the eastern boundary of No. 15)”;

(e)     the sixth entry to the item relating to Gloucester Street shall be revoked;

(f)      for the third entry to the item relating to Kensington Place there shall be substituted the words “North side (between a point 62 yards east of the east side of Kensington Street and a point 33 yards west of its junction with Parade and Cheapside”;

(g)     in the third entry to the item relating to Lewis Street for the words “Hotel Cerise” there shall be substituted the words “No. 26”;

(h)     in the fourth entry to the item relating to “Parade, The (western arm)” for the words “The Wine Lodge” there shall be substituted the words “No. 16”;

(i)      after the item and entry relating to St. Saviour’s Road there shall be inserted the following item and entry –

 

“Stafford Lane

Both sides”;

 

(j)      for the second entry to the item relating to Stopford Road there shall be substituted the following entries –

 

“North side (from a point 14 yards east of the junction with Byron Road eastwards for a distance of 33 yards)

North side (between Byron Road and a point 12 yards west)” and

 

(k)     after the item and entry relating to York Street there shall be inserted the following item and entry –

 

The unnamed road at La Collette that runs to the north of and parallel to La Rue Gosset

12      Fifth Schedule amended

In the Fifth Schedule to the principal Order after the item and entry relating to Old Don Road there shall be inserted the following item and entry –

 

“Paris Lane

13      Seventh Schedule amended

In Part IV of the Seventh Schedule to the principal Order after the item and entry relating to La Rue du Moulin de Flicquet there shall be inserted the following item and entry –

 

“La Ruelle de Rauvet

The entire road”.

14      Eighth Schedule amended

(1)     In Part I of the Eighth Schedule to the principal Order the item and entries relating to Kensington Place shall be revoked.

(2)     In Part II of the Eighth Schedule to the principal Order –

(a)     for the item and entries relating to Ann Street there shall be substituted the following item and entries –

(5)     In Part IV of the Eighth Schedule to the principal Order after the item and entry relating to Old Trinity Hill there shall be inserted the following item and entry –

18      Citation and commencement

This Order may be cited as the Road Traffic (Saint Helier) (Amendment No. 13) (Jersey) Order 2003 and shall come into force on the seventh day after it is made.
