Superannuation (Administration) (Amendment No. 2)
(Jersey) Order 2012

THE CHIEF MINISTER, in pursuance of Articles 2 and 7 of the Teachers’
Superannuation (Jersey) Law 1979[1] and after consultation with the
Management Board established under that Law, orders as follows –
1 Interpretation
In this Order, the “principal
Order” means the Teachers’ Superannuation (Administration) (Jersey)
Order 2007[2].
2 Article 18
amended
For Article 18(2) and (3) of the principal Order the following paragraphs
shall be substituted –
“(2) If there has previously been
a reduction in an increase in pensions and deferred pensions payable under any
of the Teachers’ Superannuation Schemes, the Management Board shall, in
accordance with Article 23(2)(c) and to the extent specified in Article 23,
restore the increase to the amount that it was before it was reduced.
(3) If there has previously been a cancellation
of an increase in the pensions and deferred pensions payable under any of the
Teachers’ Superannuation Schemes, the Management Board shall, in
accordance with Article 23(2)(c) and to the extent specified in Article 23,
restore the increase to the amount that it was before it was cancelled.”.
3 Article 23
amended
For Article 23(2)(c) of the principal Order the following sub-paragraph
shall be substituted –
“(c) if a reduction or
cancellation (or both) referred to in sub-paragraph (b) has taken place
within the 6 years before the date on which a report disclosing a surplus as
referred to in Article 18(1) was signed by the Actuary who prepared the
report, the Management Board shall apply the surplus in or towards making good
the loss to any individual pensioner or deferred pensioner still alive, being
the loss that was caused by the reduction or cancellation (or both).”.
4 Citation
and commencement
(1) This
Order may be cited as the Teachers’ Superannuation (Administration)
(Amendment No. 2) (Jersey) Order 2012.
(2) This
Order shall come into force on the 7th day after it is made.
