
Road Traffic (Rue des
Prés Trading Estate) (Jersey) Order 2017
THE MINISTER FOR INFRASTRUCTURE, in pursuance of Articles 62, 63, 64 and 84 of the Road Traffic
(Jersey) Law 1956 and after
consultation with the Connétables of St. Saviour, St. Clement
and Grouville, orders as follows –

PART 1
GENERAL
1 Interpretation[1]
This Order –
“general permit” shall be construed in accordance with
Article 12;
“Law” means the Road Traffic (Jersey) Law 1956;
“parking” means leaving a vehicle, whether attended or
unattended, on any part of a road specified in a table, including stopping to
load or unload goods or merchandise, but does not include stopping a vehicle to
set down or pick up passengers;
“parking card” means a device of a type and design
approved by the Minister under Article 64 of the Law;
“pay card parking place” means a part of a road
designated as a parking place under Article 4;
“permit” means a general permit or a specific permit, as
the context requires;
“permit parking place” means a part of a road designated
as a parking place under Article 10;
“road” means a road in the Trading Estate;
“specific permit” shall be construed in accordance with
Article 12;
“table” means a table in Schedules 2 to 11
specifying the part of a road subject to the restrictions under Parts 2, 3
and 4;
“Trading Estate” means the roads and parts of roads
known as the “Rue des Prés Trading Estate” described in
Schedule 1;
“valid parking card” means a parking card that
identifies for the purposes of this Order the commencement of the period when
the vehicle on which it is displayed is left in a pay card parking place by
means of clear and appropriate indications by or on behalf of the driver
of –
(a) the
month;
(b) the
date in the month;
(c) except
if it is a Sunday, the day of the week; and
(d) the
next succeeding 5 minute index within the hour of the day at which the
vehicle was first left in the pay card parking place;
“valid remote payment” means a payment in respect of a
vehicle parked or to be parked at a pay card parking place, such payment being
–
(a) made
by means of the internet;
(b) accepted
by or on behalf of the Minister; and
(c) of
the amount of the charge prescribed in Article 8 for parking the vehicle for
the period during which it is parked or to be parked.
Part 2
general restrictions and provisions on parking
2 Yellow lines and parking at a bus-stop
(1) A vehicle shall not
park on a part of a road specified in column 1 of a table.
(2) Unless otherwise
permitted under Article 3(2), a vehicle, other than a public service
vehicle of the appropriate class, shall not stop on a part of a road that is
authorized under Article 37 of the Motor Traffic (Jersey) Law 1935 as a stand for public
service vehicles.
3 Alteration
of position of vehicles and removal of vehicles in emergency
(1) Where any vehicle is
parked in any part of a road in contravention of this Order, a police officer
may alter or cause to be altered the position of that vehicle in order that its
position complies with this Order.
(2) A police officer may
move or cause to be moved to such place as the police officer thinks fit any
vehicle parked on a road if, in the police officer’s opinion, the
movement of that vehicle is necessary in the course of an emergency.
(3) The powers conferred by
this Article shall be in addition to and not in derogation of the powers
contained in Article 56 of the Law and any Order made under that Article.
PART 3
PAY CARD PARKING PLACES
4 Pay
card parking places
The parts of roads specified in column 2 of a table are
designated as parking places and are referred to in this Order as “pay
card parking places”.
5 Determination
of size and number of pay card parking places and marking of pay card parking
places
(1) The Minister may
determine the dimensions and the number of the spaces in which vehicles may be
left in a pay card parking place.
(2) The limits of any pay
card parking place and any parking space within any such place may be marked on
the road or indicated by such signs or road markings as the Minister deems fit.
6 Conditions
and restrictions relating to use of pay card parking places
(1) A vehicle may be parked
in a pay card parking place in accordance with this Order.
(2) Except where permitted
under Article 3, no vehicle shall be parked in a pay card parking place
between the hours of 8.00 a.m. and 5.00 p.m. on any day except Sunday
unless the charge specified in Article 8 has been paid.
(3) Between midnight on any
day and midnight the following day, a vehicle shall not be parked in a pay card
parking place for longer than a total aggregate period of 12 hours
(whether or not one or more pay card parking places are used during that
period).
(4) Where parking spaces
are marked in a pay card parking place a vehicle shall be parked wholly within
the limits of a marked space and shall not obstruct the entry or exit of other
vehicles to or from adjacent marked spaces or permit parking places.
7 Periods when parking charge
required[2]
(1) If a vehicle is parked in a pay card parking
place between the hours of 8.00 a.m. and 5.00 p.m. on any day except
Sunday –
(a) a valid parking card must be displayed in
such a way that it can clearly be seen by a person outside the vehicle; or
(b) a valid remote payment must have been made.
(2) In the case of paragraph (1)(a), a
person must not alter the time of arrival indicated on the parking card.
8 Charges
for parking at pay card parking places
(1) The charge for parking
a vehicle at a pay card parking place shall be one parking unit for each period
of one hour or part of one hour.
(2) In paragraph (1)
“parking unit” has the same meaning as in the Road Traffic (Public Parking Places) (Jersey)
Order 2006.
9 Purchase of parking cards[3]
Parking cards must be purchased from a person for the time being
authorised by the Minister to sell parking cards.
PART 4
PERMITS
10 Permit
parking places
The parts of roads specified in column 3 of a table are
designated as parking places and each such place is referred to in this Order
as a “permit parking place”.
11 Determination
of size and number of permit parking places and marking of permit parking
places
(1) The Minister may
determine the dimensions of a permit parking place.
(2) The limits of a permit
parking place may be marked on the road or indicated by such signs or road
markings as the Minister may deem fit.
12 Issue
of permits
(1) A person may apply to
the Minister for a general permit or a specific permit, such application being
in such form and containing such information as is required by the Minister.
(2) The Minister may grant
a maximum number of parking permits as specified in column 5 of a table of
the type specified in column 4 in respect of the corresponding part of a
road specified opposite in column 3.
(3) The Minister shall not
grant one or more general permits to a person unless the person satisfies the
Minister that the person is an owner, or is in right of an owner, of land in
the Trading Estate.
(4) The Minister shall not
grant one or more specific permits to a person unless the person satisfies the
Minister that the person is an owner, or is in right of an owner, of land that
immediately adjoins the part of the road specified in column 3 in respect
of which the application is made.
(5) Subject to paragraph (6),
no permit shall be issued to an applicant unless the first quarterly instalment
of the fee specified in Article 13(1) or (2) for each permit granted to
the applicant has been paid.
(6) If a permit is to be in
force for less than 3 months before the next quarterly instalment becomes
payable, the amount payable under paragraph (5) shall be an amount
calculated pro-rata for each day the permit is in force until the next
quarterly instalment becomes payable.
(7) A permit shall be in
such form as the Minister may determine.
(8) In this Article,
“land” means a corporeal hereditament and includes a building.
13 Parking
Permit fees
(1) The fee for a general
permit is £1,479.72 per annum payable in quarterly instalments.
(2) The fee for a specific
permit is £739.92 per annum payable in quarterly instalments.
(3) If a permit is to be in
force for less than 12 months, the fee payable shall be, for each day for
which the permit is to be in force, an amount calculated pro rata for the
amount specified in paragraph (1) or (2), as the case requires.
14 Duration
of parking permit
(1) Subject to the
provisions of this Article, a permit is valid from the date on which it is
issued until the following 31st December.
(2) A permit shall cease to
have effect if the holder of the permit no longer meets the condition for that
permit specified in Article 12(3) or (4) as the case may be.
(3) A permit holder shall
surrender his or her permit to the Minister forthwith upon the permit ceasing
to have effect under paragraph (2).
(4) Except where paragraph (2)
applies, where notice of surrender is given to the Minister, a permit shall
cease to have effect at the time the next quarterly instalment of the annual
fee is payable, disregarding any quarterly instalment that is payable less than
3 months after the date that notice is given.
(5) The Minister may at any
time revoke a permit if a permit holder fails to pay a quarterly instalment at
the time when the instalment is due.
15 Conditions
and restrictions relating to the use of permit parking places
(1) A vehicle must not be
parked in a permit parking place except in accordance with this Order.
(2) When a vehicle is
parked in a permit parking place there must be displayed a permit which allows
the holder of the permit to park in that parking place.
(3) For the purposes of
paragraph (2), a permit must be displayed in such a way that it can
clearly be seen by a person outside the vehicle.
(4) Where parking spaces
are marked in a permit parking place a vehicle must be parked so
that –
(a) it is
not parked partly in any part of the road which is adjacent to that permit
parking place; and
(b) it
does not obstruct the entry or exit of other vehicles to or from adjacent
permit parking places or pay card parking places.

Evidence
15A Evidence
(1) A digital photograph
taken by a person authorised by the Minister of a vehicle displaying a
registration mark that is parked at a pay card parking place is prima facie
evidence that the vehicle assigned that registration mark was parked at that
paying parking place.
(2) The
metadata associated with the digital photograph is prima facie evidence of the
time and day the photograph was taken.
(3) A
printed copy of the records, held by or on behalf of the Minister, of valid
remote payments made in respect of vehicles is prima facie evidence of whether
a valid remote payment was made in respect of a vehicle.

1 Roads
in the Rue des Prés Trading Estate
The Rue des Prés
Trading Estate is comprised of the following –
(a) in
the Parish of St. Saviour –
(i) the
road known as L’Avenue le Bas from its junction with La Route de
Longueville to its junction with La Rue Sinnatt,
(ii) the
road known as La Rue Martel from a point 55 yards north of its
junction with La Rue le Gros to a point 60 yards north of its
junction with La Rue Sinnatt,
(iii) the
road known as La Rue Grellier from its junction with La Rue
le Gros to a point 55 yards south of its junction with La Rue
Sinnatt,
(iv) the road
known as La Rue Sinnatt from its junction with La Rue Grellier to a
point 46 yards west of its junction with La Rue Martel,
(v) the
road known as La Rue le Gros from its junction with La Rue Grellier
to its junction with La Rue Martel;
(b) in
the parish of St. Clement –
(i) the
road known as La Rue Sinnatt from its junction with La Rue Martel to
a point 46 yards west of that junction,
(ii) the
road known as La Rue Martel from its junction with La Rue Sinnatt to
a point 20 yards north of that junction;
(c) in
the parish of Grouville, the road known as La Rue Martel from a point
60 yards north of its junction with La Rue Sinnatt to a
point 20 yards north of that junction.
